Terms and Conditions

Introduction

These Terms & Conditions apply to all purchases made through Blueshark.co.nz and MountainBikes.co.nz, operated by Blueshark Wanaka ("Blueshark", "we", "us", or "our").

By accessing our websites or purchasing products from us, you agree to these Terms & Conditions.

Product Information

We make every effort to ensure that product descriptions, specifications, pricing, and availability are accurate. However, errors may occasionally occur. We reserve the right to correct any errors and to update information without notice.

Images are provided for illustrative purposes and may differ slightly from the actual product supplied.

Pricing

All prices are shown in New Zealand Dollars (NZD) and include GST unless otherwise stated.

Prices, promotions, and product availability may change without notice.

Orders

All orders are subject to acceptance and product availability.

We reserve the right to refuse, cancel, or limit orders where pricing errors, stock discrepancies, suspected fraud, or other exceptional circumstances exist.

If payment has been received for an order that cannot be fulfilled, a full refund will be provided.

Shipping

Shipping is provided in accordance with our Shipping Policy.

Delivery dates are estimates only and are not guaranteed. While we make every effort to dispatch orders promptly, we are not liable for delays caused by couriers, weather events, supply chain interruptions, or other circumstances beyond our reasonable control.

Returns

Returns are governed by our Returns & Warranty Policy.

Change-of-mind returns may be accepted at our discretion within 7 days of delivery provided products remain unused, in original packaging, and in resalable condition.

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993.

Consumer Guarantees Act

Where products are supplied to consumers for personal, domestic, or household use, your rights are protected by the New Zealand Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies available under those Acts.

Business Customers

Where goods are acquired for business purposes, the parties agree that the Consumer Guarantees Act 1993 shall not apply to the extent permitted by section 43 of that Act.

By purchasing goods for business use, the purchaser confirms that the goods are being acquired for business purposes.

Warranties

Manufacturer warranties are subject to the terms and conditions of the relevant manufacturer.

Warranty claims for FOX and Marzocchi products must be handled directly through the authorised New Zealand distributor for those brands.

Warranty coverage does not extend to damage caused by misuse, neglect, improper installation, accidents, unauthorised modifications, or normal wear and tear.

Limitation of Liability

To the fullest extent permitted by New Zealand law, our liability is limited to the repair, replacement, or refund of the relevant product.

Nothing in these Terms excludes liability where such exclusion would be unlawful.

Privacy

Personal information provided to us will be handled in accordance with our Privacy Policy and applicable New Zealand privacy legislation.

Governing Law

These Terms & Conditions are governed by the laws of New Zealand. Any disputes arising from the use of our websites or the purchase of products shall be subject to the jurisdiction of the New Zealand courts.
